Welcome to BitFlinger LLC ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our applications, services, and websites. By using our services, you agree to be bound by these Terms.

Acceptance of Terms

By downloading, installing, accessing, or using any of our applications or services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

Description of Service

BitFlinger LLC develops and provides applications and services for various platforms including mobile, web, TV, Mac, Windows, and Linux. Our applications may include features for media management, recommendations, and user personalization based on your preferences.

Free Accounts and Subscriptions

Bitflinger TV is offered in two tiers. A free account is free to create and keep, with no payment method required and no time limit, and includes a defined set of features together with limits on how many titles each row browses and how many devices may be signed in at once. A subscription removes those limits and adds further features. The features and limits of each tier are described in the app and on our website and may change over time; where they do, we will not reduce what a paid subscription provides during a period you have already paid for.

Subscriptions are sold and billed by the Apple App Store or Google Play, not by us. Their terms govern the transaction, including any free trial or introductory offer, which is offered by the store rather than by us and is subject to that store's eligibility rules. Subscriptions renew automatically until canceled, and must be managed or canceled in your App Store or Google Play account settings. Canceling returns your account to the free tier rather than terminating it.

The two tiers differ in how your information may be used. Free access is supported in part by the rights described under "Privacy and Data" below and set out in full in our Privacy Policy. By creating or keeping a free account, you agree to those terms as they are described in the Privacy Policy in effect at the time.

User Responsibilities

You are responsible for:

  • Providing accurate information when using our services
  • Maintaining the security of your account and devices
  • Using our services in accordance with applicable laws and regulations
  • Not attempting to reverse engineer, modify, or distribute our applications without permission
  • Not using our services for any illegal, harmful, or unauthorized purposes

Intellectual Property

All content, features, and functionality of our applications and services, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of BitFlinger LLC and are protected by copyright, trademark, and other intellectual property laws.

Prohibition of Resale

Resale of any BitFlinger LLC intellectual property, metadata, images, or content is strictly forbidden. You may not, under any circumstances:

  • Resell, redistribute, or commercialize any of our applications, software, or services
  • Resell or transfer user data, metadata, or analytics collected through our applications
  • Resell, license, or distribute our images, including logos, graphics, icons, user interface elements, or any visual content
  • Resell or redistribute our written content, including documentation, help materials, marketing content, or any textual materials
  • Create derivative works for commercial resale based on our intellectual property
  • Use our intellectual property as part of any commercial offering or resale operation

This prohibition extends to all forms of our intellectual property whether obtained directly from our services, through reverse engineering, or any other means. Violation of these resale restrictions may result in immediate termination of your access to our services and legal action.

Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect user preferences to provide personalized recommendations, but we do not access or upload your local content or metadata from sources such as Jellyfin or other media servers.

Free accounts. We reserve the right to monetize information associated with free accounts, including by selling or licensing viewership, tuning, and audience-measurement data to measurement companies, data brokers, panels, and analytics partners. We are not doing so as of the effective date of these Terms. If we begin, we will first update the Privacy Policy, give notice in the app, and provide the opt-out rights described there; we will not apply it to information collected under an earlier policy that promised otherwise, and we will not sell or share the information of any user we know to be under 16.

Subscription accounts. We do not sell, rent, or trade the personal information of subscription accounts. Subscribing removes your account from any use described in the preceding paragraph for as long as the subscription is active.

Nothing in this section limits the rights the Privacy Policy or applicable law give you, including any right to opt out.

Service Availability

We strive to provide reliable and consistent service, but we cannot guarantee that our applications will be available at all times. We may modify, suspend, or discontinue any aspect of our services at any time, with or without notice.

Limitation of Liability

To the fullest extent permitted by law, BitFlinger LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Indemnification

You agree to defend, indemnify, and hold harmless BitFlinger LLC and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of our services or violation of these Terms.

Termination

We may terminate or suspend your access to our services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use our services will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the effective date. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
